- General Terms
- By availing Swastha’s services, the client agrees to abide by these Terms & Conditions.
- Swastha provides personalized home care, companionship, and wellness services for elderly individuals based on their needs.
- Services will be customized after an initial evaluation of the client’s requirements.
- Service Subscription & Payments
- Subscription Plans: Monthly, Half-Yearly, and Annual packages are available.
- Payments must be made in advance before the commencement of services.
- Additional services beyond the agreed plan will be charged separately.
- Service Customization & Scheduling
- The care plan will be designed based on the individual’s health condition, preferences, and requirements.
- Any schedule changes or rescheduling requests must be made at least 24 hours in advance.
- Swastha will try to accommodate changes, but availability is subject to staffing and operational constraints.
- Cancellation & Refund Policy
- Monthly Plans: Cancellation requests must be submitted at least 7 days in advance.
- Long-Term Plans (Half-Yearly/Annual): Cancellation requests must be submitted at least 30 days in advance.
- Refunds (if applicable) will be processed after deducting service charges and any availed benefits.
- Medical Support & Emergency Protocol
- Swastha provides non-medical and basic medical support as part of its care services.
- We are not a substitute for emergency medical services.
- In case of an emergency, Swastha will immediately inform the family/guardian, and external medical intervention may be required.
- Clients must provide accurate medical history and emergency contact details.
- Responsibilities & Liability
- Swastha ensures high-quality care but will not be responsible for any pre-existing health conditions or sudden medical emergencies.
- Clients and families must provide all necessary medical records, prescriptions, and specific care instructions.
- Swastha shall not be held liable for any health deterioration due to unforeseen circumstances or undisclosed medical conditions.
- Confidentiality & Data Protection
- All personal, medical, and financial information shared with Swastha will be kept strictly confidential.
- We do not disclose client information to third parties unless legally required or permitted by the client.
- Limitation of Liability
- Swastha and its employees, caregivers, or service providers shall not be held liable for:
- Any injury, illness, or deterioration in health due to pre-existing medical conditions.
- Delays or interruptions in service due to unforeseen circumstances.
- Any loss or damage to personal belongings.
- Errors or omissions in medical or caregiving services that result from incomplete or inaccurate information provided by the client or their family.
- The total liability of Swastha under any circumstances shall not exceed the total amount paid by the client for the services rendered in the preceding three months.
- Swastha and its employees, caregivers, or service providers shall not be held liable for:
- Tax Clause
- All prices mentioned are exclusive of applicable taxes unless explicitly stated otherwise.
- Taxes, including but not limited to Goods & Services Tax (GST) or any other statutory levies, will be charged as per government regulations.
- Any changes in tax rates or additional government-imposed charges will be reflected in the final invoice and must be borne by the client.
- Termination of Services
- Swastha reserves the right to suspend or terminate services under the following conditions:
- Non-compliance with these Terms & Conditions.
- Inappropriate behavior towards Swastha staff.
- Non-payment of dues.
- Any circumstances where service continuation is deemed unsafe or impractical.
- Swastha reserves the right to suspend or terminate services under the following conditions:
- Force Majeure
- Swastha shall not be held responsible for any failure or delay in service delivery due to unforeseen events beyond its control, including but not limited to:
- Natural disasters (earthquakes, floods, pandemics, etc.)
- Acts of war, terrorism, or civil unrest
- Government restrictions or legal regulations
- Labor strikes or technical failures
- If such an event occurs, Swastha will notify the client and resume services as soon as possible.
- Swastha shall not be held responsible for any failure or delay in service delivery due to unforeseen events beyond its control, including but not limited to:
- Jurisdiction & Governing Law
- These Terms & Conditions shall be governed by and interpreted in accordance with the laws of State of Rajasthan.
- Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Rajasthan, India.
